
When sponsoring a spouse, the sponsor will have to sigh an undertaking with the government of Canada promising to give financial support for the basic needs of his/her spouse or partner and their dependent children. These basic needs cover food, clothing, shelter and other needs for everyday living, dental care, eye care and other health needs that are not covered by public health services.
The undertaking takes effect on the date the spouse enters Canada either with temporary resident permit or the date admitted to Canada as a permanent resident and is valid for 3 years from the date of becoming a permanent resident in Canada.
Marriage immediately creates a legal relationship recognized for immigration purposes to Canada. To meet the eligibility requirement, a spouse must be at least 18 years of age, legally married and not otherwise married or in common law or conjugal relationship to someone else.
A marriage that took place outside Canada must be legal in the country where it is conducted and must conform with the Canadian Law.
Spousal reunification is of significant priority to Immigration, Refugees and citizenship Canada and its usually processed in a very timely manner.
The spouse, common-law partner or conjugal partner looking to immigrate to Canada under spousal sponsorship category must be sponsored by a Canadian citizen or permanent resident. If you applied to sponsor your spouse outside Canada, once decision is made and sponsorship application is approved, IRCC will issue the applicant Canada Spousal Visa (a confirmation of permanent residence).
Applicant (person being sponsored) will become permanent resident upon landing in Canada, and must enter Canada before the expiry date, which appears on temporary visa.
